1. Agreement to Terms
By accessing or using Enviro-D ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Enviro-D provides environmental risk intelligence and due diligence services for property assessment. The Service includes access to environmental risk data, property reports, and related analytical tools.

4. Subscriptions and Payments
4.1 Subscription Plans
Access to certain features requires a paid subscription. Subscription plans and pricing are available on our website. We reserve the right to modify pricing with reasonable notice.
4.2 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorise us to charge your designated payment method for all applicable fees.
4.3 Cancellation and Refunds
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. Refunds are provided in accordance with Australian Consumer Law and our refund policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorised access to the Service or its related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Reproduce, duplicate, copy, sell, or resell any portion of the Service without express permission
- Use automated means (bots, scrapers, etc.) to access the Service without authorisation
- Impersonate any person or entity or misrepresent your affiliation
- Upload or transmit viruses or other malicious code
6. Intellectual Property

The Service and its original content, features, and functionality are owned by Enviro-D and are protected by Australian and international copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely for the purpose of providing the Service.
6.3 Third-Party Data
The Service may incorporate data from third-party sources. Such data remains the property of its respective owners and is subject to their terms and conditions.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Environmental risk assessments and reports are provided for informational purposes only and should not be relied upon as the sole basis for property decisions. We recommend engaging qualified professionals for comprehensive due diligence.
8. Limitation of Liability
To the maximum extent permitted by Australian law, Enviro-D and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted or modified.
9. Indemnification
You agree to indemnify and hold harmless Enviro-D and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
10. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

We may revise these Terms at any time by posting an updated version on this page. Material changes will be notified to registered users via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Enviro-Dregarding the Service and supersede all prior agreements and understandings.
